    Terms & Conditions

    Last updated: August 14, 2026

    Terms of Service

    Please read these Terms of Service ("Terms"), which set forth the legally binding terms and conditions between you and Cervaspace ("Cervaspace" or the "Company"). They govern your access to and use of the Cervaspace website ("Site") and services (the "Service").

    Our collection and use of personal information in connection with your access to and use of the Service is described in our Privacy Policy.

    Acceptance of Terms

    Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service (collectively referred to as "Users") and to all applicable laws, conditions, and policies referenced here. The Service is offered subject to acceptance of all of the terms and conditions contained in these Terms and all other operating rules, policies, and procedures that may be published on the Site by the Company, which are incorporated by reference, including the operating rules, policies, and procedures of third-party service providers referenced herein. These Terms apply to every user of the Service.

    Some Services offered through the Site may be subject to additional terms and conditions adopted by the Company. Your use of those services is subject to those additional terms and conditions, which are incorporated into these Terms by this reference.

    By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

    Additional Policies and Agreements

    Your use of our Services is also governed by the following policies, which are incorporated by reference:

    • Privacy Policy
    • Acceptable Use Policy
    • Domain Registration Agreement (where applicable)
    • Refund Policy
    • Backup Policy

    Additional terms may also apply to certain Services and are incorporated by reference as applicable in these Terms.

    User Agreement

    Agreement to Cervaspace's Acceptable Use Policy and Terms of Service is mandatory for using our services and governs the usage of these services.

    During the term of your agreement with Cervaspace, you must ensure that your use of any resource offered to you or owned or controlled by Cervaspace ("Service") conforms with Cervaspace's current Acceptable Use Policy ("AUP"). Cervaspace may modify the AUP from time to time. Any material changes will take effect no less than 7 (seven) days after notice is provided to Users by email or through the client portal, unless a shorter period is required by law or to protect the security or integrity of the Services. Continued use of the Services after such notice constitutes acceptance of the revised AUP.

    If any of these policies are infringed, we reserve the right to suspend the violating account or services without prior notice.

    We do not permit "high-yield investment programs" (HYIP), Ponzi schemes, gambling, e-gold doublers, or similar sites.

    Cervaspace reserves the right, at its sole discretion, to modify or replace these Terms from time to time by posting the updated terms on the Site. It is your responsibility to check the Terms periodically for changes. If you object to any such changes, your sole recourse will be to cease using the Site and the Service. Your continued use of the Service following the posting of any changes to the Terms will indicate your acknowledgment of such changes and agreement to be bound by the revised terms.

    Cervaspace reserves the right to change, suspend, or discontinue the Service (including, but not limited to, the availability of any feature, database, or content) at any time for any reason. Cervaspace may also impose limits on certain features and Services or restrict your access to parts of or the entire Site without notice or liability.

    Client Account Registration

    To initiate and commence use of our Services, all Users must register an account ("Account").

    All Users, whether registering as an individual or a company, must provide the name of at least one natural person.

    If you are registering an Account for a company or other legal entity, you must provide the name of a natural person along with the name of the company you represent. You represent and warrant that you have the authority to legally bind that entity and to grant us all permissions and licenses provided in these Terms.

    You must provide accurate, current, and complete information during the registration process and must always keep your Account profile information up-to-date.

    You are responsible for safeguarding the password that you use to access the Service and for all activities or actions under your password, whether your password is with our Service or a third-party service. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

    You may not use as a username the name of another person or entity, a name or trademark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar, or obscene.

    You are liable for all activities conducted through your Account unless such activities were not authorized by you and you were not otherwise negligent (for example, failing to report the unauthorized use or loss of your credentials).

    When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

    We will set up your account after we have received payment and after we and/or our payment partners have screened the order(s) in case of fraud. You can make payment via bank transfer or through any of our online payment options. If you choose to pay via cash deposit, we may request additional KYC information for security reasons before activating the service. This KYC process applies per client account.

    It is your responsibility to provide us with an email address that is not a webmail account (e.g., mail@yourdomain.com) for the domains you sign up under. If there is ever an abuse issue or we need to contact you, the primary email address on file will be used. You are responsible for ensuring the email address on file is current and up to date at all times. If you have a domain name registered with Cervaspace, you are responsible for ensuring that the contact information for your domain account and your domain name(s) are correct and up-to-date. Cervaspace is not responsible for a lapsed registration due to outdated contact information. To verify or change this information, contact our support team at support@usecerva.com. Cervaspace reserves the right to suspend or terminate an account where materially false, inaccurate, or fraudulent information is provided. Except in cases of suspected fraud or unlawful activity, Users will be given reasonable notice and an opportunity to correct inaccurate information before termination.

    You are responsible for your sites and all sites that you host to be in accordance with all rules on this page. Misuse by you may result in actions on your account, including removal from the host with or without notice and without a refund.

    Representations and Warranties

    You make the following representations and warranties to us at the time of agreeing to these Terms and each time you use the Services:

    • you are over the age of 18 years;
    • you are of sound mind and have the capacity to enter into a legally binding contract and these Terms;
    • all personal information that you provide about yourself is accurate and true to the best of your knowledge;
    • you hold a bank account or access to a payment method issued by a recognized financial institution in your own name and will use this to pay for services when you conduct transactions on the Site;
    • if you are registering or accepting these Terms on behalf of a legal entity such as a company, trust, or partnership, you are legally authorized to do so and we may request evidence of such authorization;
    • you are not breaching any laws or regulations applicable to you or any company, trust, or partnership on whose instructions you are acting;
    • you are the owner of, and responsible for, all content or information residing on, obtained, or transmitted via the Service, regardless of whether such use is by you.

    Domain Name Registration

    Before purchasing a domain name on our Site, you must ensure that the domain name does not infringe on any domain name, trademark, or trade name of a third party.

    Any domain name or trademark dispute regarding your domain name will be resolved in accordance with our Trademark/Copyright Infringement Policy.

    Where applicable, all domain names purchased on our Site are subject to our:

    • Domain Registration Agreement for gTLDs and ccTLDs
    • Domain Name Deletion and Auto-Renewal Policy

    Transfers from Other Providers

    Upon your request, our migration team will make reasonable efforts to help you move your site or services to Cervaspace. However, transfers are provided as a courtesy service, and we cannot guarantee the availability, possibility, or time required to complete an account transfer. Each hosting environment is configured differently, and some platforms store data in incompatible or proprietary formats, which may make it extremely difficult, if not impossible, to migrate some or all account data. While we will endeavour to assist with the transfer, in some cases we may be unable to assist you with migrating data from another provider.

    The free migration service is available for 30 days from your service start date. Transfers outside the 30-day period will incur a charge; please contact us at support@usecerva.com for a quotation.

    Transfers of Registered Accounts and Websites

    To access the account of any registered client or to have an account transferred to you or another registrar, you must establish your relationship with our registered client. When you have established your relationship with our registered client, we will notify the client of your request. Upon receiving the written consent of the registered client to transfer the account to you and upon receiving a signed indemnity letter from you, we will transfer the website or services to you or your preferred registrar.

    Where you claim that your website was developed by one of our registered clients, we will require that client's written consent to transfer the website to you or another registrar.

    Where you claim that the registered client is deceased, you must provide a death certificate. Upon providing the death certificate, you will need to sign a letter of undertaking and indemnity and submit an affidavit stating that you are assuming responsibility for the account and will indemnify Cervaspace from all liability. In all such cases, Cervaspace will only transfer or provide access to accounts or content upon receipt of legally valid documentation, in compliance with applicable succession and data protection laws. We reserve the right to request additional proof as necessary to protect the rights of our clients and their estates.

    Intellectual Property

    The Service and its original content, features, and functionality are and will remain the exclusive property of Cervaspace. The Service is protected by copyright, trademark, and other laws of the applicable jurisdiction. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Cervaspace.

    You agree not to directly or indirectly: (i) decipher, decompile, disassemble, reverse engineer, or otherwise attempt to derive any source code or underlying ideas or algorithms of any part of the Service, except to the extent applicable law specifically prohibits such restriction; (ii) modify, translate, or otherwise create derivative works of any part of the Service; or (iii) copy, rent, lease, distribute, or otherwise transfer any of the rights you receive hereunder.

    If you provide feedback, comments, or suggestions concerning the Site or Services ("Feedback"), Cervaspace will be free to use, disclose, reproduce, license, or otherwise distribute or exploit such Feedback in its sole discretion without any obligation or restriction of any kind, including intellectual property rights. You understand that incorporating Feedback into our products or services does not grant you any proprietary rights therein.

    Prohibited Activities

    You will not use the Site or Services in connection with any transaction that is illegal, involves illegal items, or is for any illegal purpose. Cervaspace, in its sole discretion, may refuse to complete any transaction that we have reason to believe is unauthorized or that may violate any law, rule, or regulation.

    You are solely responsible for compliance with all applicable laws, rules, regulations, and tax obligations related to your use of the Services.

    In connection with your use of the Site, you will not and will not assist or enable others to:

    • breach or circumvent any applicable laws or regulations, agreements with third parties, third-party rights, or these Terms;
    • use the Site or its content for any commercial or other purposes not expressly permitted by these Terms, or in a manner that falsely implies endorsement, partnership, or affiliation with Cervaspace;
    • copy, store, or otherwise access or use information, including personally identifiable information about any other User, inconsistent with our Privacy Policy or these Terms, or in violation of the privacy rights of Users or third parties;
    • use the Site in connection with the distribution of unsolicited commercial messages ("spam");
    • use the Site with the intention of circumventing any fees or for any other improper purpose;
    • use the Site to host cryptocurrency miners, cryptocurrency exchanges, or websites employing illegal or deceptive marketing practices; cryptocurrency wallets, or cryptocurrency trading platforms;
    • use the Site to host or link a website intended to deceive the public, including sites listed at aa419.org and escrow-fraud.com;
    • host High-Yield Interest Programs (HYIP) or related investment sites such as FOREX, e-gold exchanges, Ponzi schemes, MLM/pyramid schemes, or cryptocurrency;
    • request, accept, or make any payment for services outside the Site. If you do so, you acknowledge and agree that you: (i) would be in breach of these Terms; (ii) accept all risks and responsibility for such payment; and (iii) hold Cervaspace harmless from any liability for such payment;
    • discriminate against or harass anyone on the basis of race, tribe, origin, religion, gender, disability, medical condition, marital status, age, or otherwise engage in abusive or disruptive behaviour;
    • use, display, mirror, or frame the Cervaspace platform or its content, or any individual element, Cervaspace's name, trademark, logo, or other proprietary information, or the layout and design of any page, without our express written consent;
    • dilute, tarnish, or otherwise harm the Cervaspace brand, including by registering and/or using Cervaspace or derivative terms in domain names, trade names, or trademarks that imitate or are confusingly similar to our domains, trademarks, or campaigns;
    • use any robots, spiders, crawlers, scrapers, or automated means to access, collect data, or interact with the Cervaspace platform;
    • avoid, bypass, remove, deactivate, or otherwise circumvent any technological measure implemented by Cervaspace or its providers;
    • attempt to decipher, decompile, disassemble, or reverse engineer any software used to provide the Cervaspace platform;
    • take any action that damages or adversely affects the performance or functioning of the Cervaspace platform;
    • violate or infringe any third party's rights or cause harm to any third party.

    Cervaspace has no obligation to monitor access to or use of the Site by any User or to review, disable, edit, or remove any User content, but has the right to do so to: (i) operate, secure, and improve the Site (including fraud prevention, risk assessment, investigation, and customer support); (ii) ensure Users' compliance with these Terms; (iii) comply with applicable law or court / law enforcement orders; (iv) respond to content that is harmful or objectionable; or (v) as otherwise set forth in these Terms. Users agree to cooperate with and assist Cervaspace in good faith and provide such information and take such actions as may be reasonably requested by Cervaspace regarding any investigation of use or abuse of the platform.

    If you believe any User is acting inappropriately (offensive, violent, threatening, suspected theft, or otherwise disturbing behaviour), report the person to the appropriate authorities and contact us with your report details. This does not obligate us to take any action beyond what is required by law or cause us to incur any liability to you.

    The use of our services to infringe upon any copyright or trademark is prohibited. This includes unauthorized copying of music, books, photographs, or other copyrighted works. The sale of counterfeit merchandise will result in immediate termination of your account. Any account found violating another's copyright will be removed or have access disabled. Repeat infringers will have their accounts suspended or terminated. If you believe your copyright or trademark is being infringed, email support@usecerva.com with the required information. For licensing issues, we may require further documentation.

    Any violation may result in suspension or termination of your services, with or without notice. All abuse issues must be raised via support ticket or email and will receive a response within 48 hours.

    Potential harm to minors is strictly forbidden, including child pornography or content perceived to be child pornography. Any account found hosting or linking to child pornography will be suspended immediately without notice.

    Resellers: We will suspend the offending account and notify you so you may take action. We will further monitor your activity; more than one infraction may result in immediate termination of your reseller account. Direct customers: Your services will be terminated with or without notice.

    It is your responsibility to ensure that scripts/programs installed under your account are secure and that directory permissions are properly set, regardless of installation method. Where possible, set directory permissions to 755 or as restrictive as possible. Users are ultimately responsible for all actions taken under their account, including the compromise of credentials. You must use strong passwords. If a weak password is detected, your account may be suspended until you agree to use a stronger one. We may audit accounts to prevent weak passwords. If your password is found to be weak, we will notify you and allow time to change it.

    Zero-Tolerance Spam Policy

    We maintain a zero-tolerance stance against the sending of unsolicited emails, bulk email, and spam. "Safe lists" and purchased lists are treated as spam. Any user who sends spam will have their account terminated with or without notice.

    Payment Information

    You agree to supply appropriate payment for the services received from Cervaspace in advance of the time period during which such services are provided. You agree that, until and unless you notify Cervaspace of your desire to cancel any or all services received, those services will be billed on a recurring basis.

    As a client of Cervaspace, you are responsible for ensuring that your payment information is up to date and that all invoices are paid on time. You agree that, until and unless you notify Cervaspace of your desire to cancel any or all services (by the proper means listed in the relevant section of these Terms), those services will be billed on a recurring basis unless otherwise stated in writing by Cervaspace.

    It is your responsibility to notify our billing team at billing@usecerva.com after paying for a renewal or service upgrade. Product/service renewal notices and invoices are provided as a courtesy reminder; Cervaspace cannot be held responsible for failure to renew a product/service or failure to notify you of a renewal. Cervaspace will make reasonable efforts to reconcile payments received with outstanding invoices. Customers are encouraged to notify the billing team of completed payments to ensure prompt account renewal.

    You agree that Cervaspace may seek all lawful means to retrieve payment, including (but not limited to) immediate suspension or termination, without notice, of any domain names or Services registered or renewed by you should we be unable to charge your payment method for the full amount owed, or if we receive notice of a chargeback, reversal, payment dispute, or are charged a penalty for any fee previously charged to you. You also agree that all access and privilege in and use of any domains, services, content, and/or products purchased through Cervaspace, including all data hosted on our systems, may be taken into control in satisfaction of any liability owed by you to Cervaspace. We will only restore your access and control over these Services at our sole discretion and subject to our receipt of the unpaid fees.

    Credits or deposits may be applied to your Cervaspace account balance. Your account balance displays the total credit that has not yet been applied to a purchase. You may view your balance at any time by logging into your Cervaspace client account. Credits are applied when you apply them manually or via API to an invoice. Your account balance may only be used for the purchase and renewal of services offered by Cervaspace. The use of credits for purchases or renewals of any affiliated service is subject to the Company's discretion.

    By paying for an invoice or making a deposit to your account, you acknowledge that you have read and agreed to our Refund Policy.

    No refunds can be given once a domain is renewed. All domain registrations and renewals are final.

    Cervaspace reserves the right to change any product/service fee and any other charges at any time.

    Backups and Data Loss

    Your use of the Service is at your sole risk. Cervaspace is not responsible for files and/or data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backups of files and data stored on Cervaspace servers. Please refer to our Backup Policy for more information.

    Promotional Terms

    If you purchased a product/service during a promotion or as part of a bundle (for example, a free domain name) and you fail to renew it before its expiration or change the billing cycle during the promotional period, the promotional terms become void. The free product will be charged at the then-current standard renewal rate.

    Domain name promotional discounts do not apply to renewals, transfers, premium domains, trademark domains, or pre-registration fees unless otherwise stated in the promotional communication.

    Cancellations and Refunds

    Cervaspace reserves the right to cancel, suspend, or otherwise restrict access to an account at any time with or without notice.

    Any abuse of our staff in any medium or format will result in the suspension or termination of your services.

    Only first-time accounts are eligible for a refund. For example, if you have had an account with us before, canceled, and signed up again, you will not be eligible for a refund, nor will you be eligible if you have opened a second account.

    Violations of the Terms of Service waive the Refund Policy.

    Resource Usage

    Users may not:

    1. Use 25% or more of system resources for longer than 90 seconds. Activities that may cause such problems include CGI scripts, FTP, HTTP, and database queries.
    2. Run standalone, unattended server-side processes at any point in time, including daemons.
    3. Run any web spider or indexer on shared servers.
    4. Run any software that interfaces with an IRC network.
    5. Run any bit torrent application, tracker, or client. You may link to legal torrents off-site but may not host or store them on our shared servers.
    6. Participate in any file-sharing or peer-to-peer activities.
    7. Run any gaming servers (such as counter-strike, half-life, battlefield, etc.).
    8. Run cron entries with intervals of less than 15 minutes.
    9. Run any database queries longer than 15 seconds. Tables should be indexed appropriately.
    10. Use PHP include functions to include remote files. Include local files rather than URLs (for example, include("include.php") instead of include("http://yourdomain.com/include.php")).
    11. To reduce usage, do not force HTML to handle server-side code (such as PHP and SHTML).
    12. Use the HTTPS protocol only when necessary; encrypting and decrypting communications is more CPU-intensive than unencrypted communications.

    Bandwidth Usage

    You are allocated a monthly bandwidth allowance that varies depending on the hosting or cloud package you purchase. If your account exceeds the allocated amount, we reserve the right to: suspend the account until the next allocation period; suspend until additional bandwidth is purchased; suspend until you upgrade to a higher package; terminate the account; or charge an additional fee for overages. Unused bandwidth in one month does not carry over to the next month.

    Reseller: Client Responsibility

    Resellers are responsible for supporting their clients. Cervaspace does not provide direct support to a Reseller's clients. If a reseller's client contacts us, we reserve the right to place the client account on hold until the reseller assumes responsibility. All support requests must be made by the reseller on behalf of their clients for security purposes. Resellers are responsible for all content stored or transmitted under their reseller account and for the actions of their clients. Cervaspace will hold any reseller responsible for any client actions that violate the law or these Terms.

    Shared (Non-Reseller) / Semi-Dedicated Servers and Cloud Instances

    Shared, semi-dedicated, and entry-level cloud accounts may not resell web hosting. To resell hosting you must use a reseller or dedicated/cloud hosting plan.

    SSL Certificate Revocation

    Cervaspace reserves the right to revoke your SSL certificate without notice at any time if:

    1. we discover that the information in your certificate is no longer valid;
    2. you fail to perform your obligations under this agreement; or
    3. Cervaspace determines in its sole discretion that you have engaged in harmful or abusive activities.

    Price Changes

    We reserve the right to change prices published on the Cervaspace website, and the right to change the resources included in plans, at any time.

    Indemnification

    You agree to indemnify and hold harmless Cervaspace, its affiliates and subsidiaries, its officers, directors, employees, and agents, against all liabilities, costs, expenses, damages, and losses (including direct, indirect, or consequential losses, loss of profit, loss of reputation, and all interest, penalties, and legal/professional costs) suffered or incurred as a result of:

    • your fraudulent or illegal use of the Services or the Site;
    • your negligence or any default by you of these Terms;
    • any inaccurate or incomplete information you have knowingly provided to us;
    • allowing any other person to access your account, with your permission or as a result of your failure to keep your username and password private;
    • any service that you have offered, with or without our permission, to a third party using the Company's Services or Website;
    • any claim against you for actual or alleged infringement of the Company's Intellectual Property Rights or any third party's Intellectual Property Rights arising out of or in connection with the Services or your use of the Site.

    Limitation of Liability

    Cervaspace, its directors, employees, partners, agents, suppliers, and affiliates, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from: (i) your access to or use of, or inability to access or use, the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; or (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed its essential purpose.

    Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

    Because some jurisdictions do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, the above limitations may not apply to you. In such cases, our total cumulative liability to you for any cause of action, whether in contract, tort (including negligence), strict liability, or otherwise, shall not exceed the amounts paid by you to Cervaspace for the Service giving rise to the claim.

    Disclaimer

    Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

    Cervaspace, its subsidiaries, affiliates, and licensors do not warrant that: (a) the Service will function uninterrupted, securely, or at any particular time or location; (b) any errors or defects will be corrected; (c) the Service is free of viruses or other harmful components; or (d) the results of using the Service will meet your requirements.

    Disclosure to Law Enforcement

    Cervaspace may disclose any subscriber information to law enforcement agencies without further consent or notification upon lawful request. We will cooperate fully with law enforcement agencies.

    Changes to the TOS

    Cervaspace reserves the right to revise these Terms at any time. Changes will be posted on the Site and become effective immediately. Your continued use of the Service after any such changes constitutes acceptance of the revised Terms.

    Termination

    We may terminate or suspend your access to the Services, in whole or in part, including deletion or confiscation of all files, content, and/or domain name registrations, without notice if:

    1. you fail to pay any fees due to Cervaspace;
    2. you violate the terms and conditions of this Agreement;
    3. your conduct may harm Cervaspace or others, cause Cervaspace to incur liability, or disrupt its business operations (as determined by Cervaspace in its sole discretion);
    4. you are abusive toward our staff in any manner; or
    5. for any other lawful reason, including to comply with applicable law or as specified in this Agreement.

    Upon termination, your right to use the Service will immediately cease and we will not refund any fees paid in advance. You will remain obligated to pay all fees and charges accrued prior to the effectiveness of termination.

    Governing Law

    These Terms shall be governed and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law principles.

    Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a competent court, the remaining provisions will remain in full force and effect. These Terms constitute the entire agreement between us regarding the Service and supersede and replace any prior or contemporaneous agreements, communications, or understandings.

    Dispute Resolution

    Any disputes arising under or in connection with the validity, interpretation, and performance of these Terms between Cervaspace and any third parties that cannot be resolved amicably by the parties through negotiation within 30 (thirty) days shall be resolved by Arbitration at the Lagos Court of Arbitration (LCA) before a single arbitrator in accordance with the Arbitration and Conciliation Act, Cap A18, Laws of the Federation of Nigeria.

    The Parties shall endeavour in good faith to mutually agree on the selection of an arbitrator. If the Parties cannot mutually agree on the selection of an arbitrator within ten (10) days of the request, they shall apply to the LCA to appoint an arbitrator. Arbitration proceedings shall be conducted in Lagos. The arbitrator will be requested to render an award within ninety (90) days and to provide, in writing, the reasoning for the award. The decision of any such arbitrator shall be final and binding on the parties.

    Each party shall bear its cost in connection with the Arbitration and the arbitrator's fees shall be split equally between both parties.

    Feedback

    We welcome and encourage you to provide feedback, comments, and suggestions for improvements to the Cervaspace Site or Services. You may submit Feedback by emailing us, through the contact section of the Site, or by other means. Any Feedback you submit will be considered non-confidential and non-proprietary. By submitting Feedback, you grant Cervaspace a non-exclusive, worldwide, royalty-free, irrevocable, sublicensable, perpetual license to use and publish those ideas and materials for any purpose, without compensation to you.

    Bulk Email

    Customers sending bulk email must provide recipients with an easy and effective mechanism to unsubscribe from the mailing list. The customer must include the source of the recipient's address in each bulk email message.

    CPU Usage

    Sites must not use extreme unwarranted CPU usage. This includes oversized "heavy" scripts or files to the point where most users would be unable to use the site in a reasonable amount of time. No single site may consume 30% of CPU for a sustained period.

    File Repository / Dump Sites

    Customers may not use disk space as a file repository or dump site. This includes (but is not limited to): warez, serials, sound files, applications, and archive files. Using space to store content for other sites (remote linking) is also prohibited, for example storing images for auction listings, other websites, or linked resources.

    Violation of Rules

    Breaking any of these rules may result in immediate account suspension, without notice and without refund, and may also lead to criminal prosecution where deemed necessary.
